  1. GENERAL TERMS
    1. Grenardi Estonia OÜ, registry code: 11518421, legal address: Peterburi tee 46, Tallinn 11415, hereinafter: GRENARDI, provides services that are available on the website www.grenardi.ee, hereinafter: website. When visiting and using the website, we invite you to familiarize yourself with these terms and conditions, as well as the privacy policy and delivery and return conditions.
    2. If the consumer buys the products (goods) offered on the GRENARDI website, such a mutual agreement constitutes a contract concluded by means of communication in accordance with § 52 of VÕS, the Consumer Rights Protection Act and Directive 97/7/EC of the European Parliament and of the Council on the protection of consumers in the case of contracts concluded by means of communication .
  2. PROTECTION OF PERSONAL DATA
    1. GRENARDI processes personal data in accordance with the General Regulation on Personal Data Protection and other data protection laws.

  3. PRICES
    1. The prices on the website are presented in euros (EUR).
    2. Taxes applicable to the goods are included in the price.
    3. GRENARDI reserves the right to change prices at any time without notice. The consumer has the right to buy goods and services at current prices.
  4. PURCHASE AND PAYMENT ORGANIZATION AND SECURITY
    1. If you have put the product in the virtual shopping cart, it is reserved for one hour, but if you are a member of the GRENARDI loyalty program, it is reserved for 24 hours. After that, we no longer guarantee that the reserved product will be available to you and you will need to add it to your cart again if you want to buy it.
    2. You can pay for the purchase of goods or services on the website via internet banking or by using a printed or electronic gift card purchased on the website. Please note that on the GRENARDI website it is not possible to pay with a gift card received during the exchange of goods in the GRENARDI store. Available payment methods and cards we accept are listed on our website.
    3. Payment processing is ensured by the payment platform makecommerce.ee. The personal data required to make payments are transferred to the platform owner Maksekeskus AS.
    4. You also have the option to buy our products on installments using the interest-free installments offered by GRENARDI and guaranteed by our partners. If you choose the payment term that suits you (3, 6 or 12 months), your purchase amount will be divided into proportional installments. 
You must use Smart-ID, Mobile-ID or ID-card identification to process the rental purchase. In order for our partners to assess whether your income and existing obligations are relevant for us to provide you with such a service, you will need to enter additional information about yourself. Before entering into a contract, you can learn more about how your data is processed in the "Privacy Policy" section. Before signing the payment agreement, you must familiarize yourself with the section "General terms and conditions of the loan agreement".
    5. GRENARDI does not guarantee that it accepts payment with all payment cards. If you have problems with your payment card, please contact [email protected] and provide your payment card number.
    6. GRENARDI does not store your payment card details or other payment information.

  5. DELIVERY PROCEDURE AND RETURN OF GOODS
    1. Delivery of the parcel machine on the territory of Estonia is free.
    2. Delivery by courier to a specific address or express delivery is a paid service regardless of the purchase amount.
    3. The amount of the delivery fee depends on the delivery service provider you choose and the type indicated on our website.
    4. If you are a consumer, you have the right to withdraw from a purchase contract concluded by purchasing goods on the website within 14 days of receiving the goods without giving any reason. You can return the product free of charge to any GRENARDI store or send it to us with an Omniva or Itella Smartpost parcel machine, using the return code sent by the company that guarantees the delivery. If you choose another return method, you will bear the return costs.

  6. GUARANTEE AND QUALITY
    1. GRENARDI takes care of the quality of its products. You have the right to contact GRENARDI within two years of purchase for a non-conforming product.
    2. Complaints about the quality of the goods will be considered only upon presentation of the purchase document.
    3. Some jewelery manufacturers have given their products a special guarantee. When purchasing goods on the website, you will be informed about the terms and duration of such a guarantee in the certificate attached to the product or in GRENARDI stores.
    4. The quality guarantee given by the manufacturer or GRENARDI does not limit the legal rights of the consumer when purchasing a low-quality product or service.
    5. If the goods do not conform to the contract, you have the right to require GRENARDI to eliminate the non-conformity or to replace the goods, unless this is impossible or disproportionate or causes GRENARDI costs that are not reasonable compared to other solutions.
    6. GRENARDI will replace or repair such a product free of charge, taking into account both the characteristics of the product and its intended use. The repair time is determined in each case individually, taking into account the nature of the damage.
    7. Gemstone products and custom-sized jewelry are not eligible for exchange, except in the case of a latent manufacturing defect that cannot be corrected by repair.
    8. Products ordered by the customer from the manufacturer's catalog independently, on the basis of individual measurements, are treated as a special order. The 14-day return policy applicable to remote purchases does not apply to custom-ordered goods.
    9. Rhodium-plated and gold-plated jewelry is subject to natural wear and tear, which does not constitute a defect and is not covered by the product warranty.
    10. GRENARD's service partner SIA Goldwork performs warranty repair of jewelry. If you need repair service, you can have the product repaired at the nearest GRENARD store.
    11. Warranty repair of products of certain brands is carried out by their manufacturer.
    12. Warranty repair is not carried out if
      1. the product is arbitrarily damaged;
      2. the terms of use and maintenance of jewelry have not been followed;
      3. the jewelry has been repaired or its original design changed by another master who is not a GRENARDI service jeweler.
    13. The consumer has the right to demand that GRENARDI reduce the price of the goods accordingly or cancel the contract and compensate the amount paid for the goods, if GRENARDI has not corrected the non-compliance or replaced the goods within a reasonable time, or if these actions cause significant inconvenience to the consumer.
    14. When reducing the price or canceling the contract and returning the amount paid for the goods to the consumer, the depreciation of the product or the profit from the use of the consumer's goods, which the parties have also agreed on, may be taken into account.
    15. If the non-conformity is insignificant and cannot significantly affect the consumer's ability to use the product, the consumer cannot demand GRENARD to cancel the contract and reimburse the amount paid for the product. The non-conformity of the product to the contractual conditions is considered insignificant if it does not significantly reduce the quality of the main functions of the product or the operational characteristics and it can be corrected without causing a visually detectable change to the goods. The product is not considered non-compliant if the consumer knew or could not have known at the time of the contract that the product was non-compliant (for example, by purchasing a used product with a small defect).
    16. In the case of consumer claims, the purchase contract will not be canceled and money will not be returned for goods that have been damaged intentionally or through negligence (exposure to chemicals, open flames, high temperatures, sharp objects, etc.) or if the terms of use and care of the goods have been violated or if the goods have been used incorrectly or for purposes other than those provided for.
  7. USER RESPONSIBILITY
    1. When entering or using the website, you must comply with the terms of use of the GRENARDI website set forth in this document and all specific warnings or instructions published on the website regarding access or use. You must always act in good faith, in accordance with the law and generally accepted practices. You may not make changes to the website, its content or services or interfere in any way with the operation or functionality of the website. If you knowingly or negligently breach your obligations under these Terms, you will be liable to GRENARDI, our affiliates, partners or licensors for all damages caused by such breach.
  8. YOUR GRENARDI PROFILE
    1. By visiting the homepage, you can register your profile on it. To do this, you must provide your personal information and use one of the provided authentication tools.
    2. If you would like to know how GRENARDI processes your profile data, please consult our “Privacy Policy” section.
    3. When you register your profile, you will automatically be given a customer card number, which you can use to make cheaper purchases on the GRENARD website and in stores.
    4. You can change your profile data at any time. You can also set your own special dates, such as birthdays, on which you will receive special offers from GRENARDI.
    5. If you want to delete your profile on the website, contact us by writing to the e-mail address [email protected]. If you delete your profile, you will not be able to update it and you will permanently lose the discounts and other benefits offered by the GRENARDI customer program.

    1. We are not responsible for the content of other websites to which links from our website lead. The links displayed on the website are for your convenience only. Use of links to or from other websites, home pages, is at your own risk.   10. INTELLECTUAL PROPERTY
    1. All information and content on this website, including trademarks, logos, text, graphics, button icons, images, audio recordings, data sets and software, are the property of GRENARDI, our affiliates or partners and are protected by intellectual property laws and regulations. Use of our trademarks in any form or for any purpose is not permitted without our express written permission, except as expressly permitted by law.
  11. DISPUTE RESOLUTION PROCEDURE
    1. In the event of disputes related to the website, the laws and regulations of the Republic of Estonia shall apply to all rights and obligations set forth in these terms and conditions and to all actions falling within the scope of their regulation.
    2. All disputes between the parties, which concern the visit to the website or arise in connection with the execution, interpretation or expiration of this remote contract, will be resolved through mutual negotiations.
    3. If the parties are unable to resolve the dispute through mutual negotiations, either party has the right to appeal to the court of the Republic of Estonia.
    4. If you believe that GRENARDI has violated consumer protection rules, for example in connection with providing information about the service, a distance contract or the right of withdrawal, first send a reasoned complaint to [email protected]. We will review your complaint and provide a response. If you do not agree with our answer, you can contact the Consumer Disputes Commission for out-of-court dispute resolution.     5. If a dispute arises between GRENARDI and the consumer regarding data protection issues, either party has the right to apply to the court as well as to the Estonian Data Protection Inspectorate at Tatari 39, Tallinn 10134, Estonia.
  12. GENERAL PROVISIONS
    1. These terms constitute the entire agreement between you and GRENARDI regarding the use of this website and its content.
    2. GRENARDI has the right to correct and specify the conditions at any time by publishing the corresponding changes on the website and providing the date of the last changes. Any changes made to these terms and conditions will be effective immediately upon their publication. If you continue to use the website after such changes, it means that you accept all changes.
  13. FORCE INCREDIBLE
    1. GRENARDI shall not be liable for any delay or failure to perform due to circumstances and obstacles beyond our reasonable control and which could not be foreseen or prevented, including strikes, government orders, acts of war or national emergency, threats of terrorism or -acts, environmental or climatic anomalies, non-fulfilment of obligations by third parties, interruptions in the Internet connection and computer equipment and software failures. In the event of such force majeure, we will contact you and try to resolve the delays as soon as possible.
